RAFFY IS NOT AN EMERGENCY SERVICE. IF A CHILD IS IN IMMEDIATE
DANGER, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.
Raffy is designed to provide comfort, emotional support, and
age-appropriate coping tools for children and families. Raffy does not provide:
- Medical care, diagnosis, or treatment of any
kind
- Mental health therapy, counseling, or
psychiatric services
- Crisis intervention or emergency response
- Abuse detection, reporting, or child protective
services
- Suicide or self-harm risk assessment or
prevention

emotional, or therapeutic outcome
CRITICAL LIMITATION: The artificial intelligence powering Raffy
cannot reliably detect, identify, or respond appropriately to medical
emergencies, suicidal ideation, self-harm, abuse disclosures, trauma responses,
mental health crises, or dangerous situations. Raffy’s AI may respond in ways
that are incomplete, inaccurate, or contextually inappropriate, even when a
child is in distress. Caregivers must not rely on Raffy to detect or
communicate a child’s crisis state.
If you or a child are experiencing a medical emergency,
mental health crisis, suicidal thoughts, self-harm thoughts, abuse, neglect,
danger, or any urgent safety concern, call 911 or contact the appropriate
emergency, medical, mental health, crisis, or child protection services
immediately.
Useful crisis resources include the 988 Suicide and Crisis
Lifeline (call or text 988) and the Crisis Text Line (text HOME to 741741).
Battle Buddy Bears does not endorse, guarantee, control, or maintain these
services.
2. Artificial Intelligence Disclaimer and Limitation of Liability for AI
Interactions
The Raffy App uses artificial intelligence language model
technology to generate conversational responses for children. By permitting a
child to use Raffy, you acknowledge and agree to the following:
A. Nature of AI Responses
Raffy’s responses are generated by AI systems and are not
created, reviewed, or approved in real time by licensed physicians, therapists,
counselors, social workers, or any other qualified professional. AI responses
are designed to be supportive and age-appropriate but may be:
- Inaccurate, incomplete, or contextually
inappropriate - Unable to recognize or respond correctly to a
child in crisis - Unable to substitute for professional clinical
judgment
- Based on patterns in training data that may not
apply to a specific child’s situation
B. No Guarantee of Appropriateness
Battle Buddy Bears does not guarantee that any AI-generated
response is appropriate for your child’s specific medical, emotional,
developmental, or psychological circumstances. Parent and caregiver supervision
is required at all times.
C. No Therapeutic or Clinical Relationship
Use of the Raffy App does not create a doctor-patient
relationship, therapist-client relationship, counselor-client relationship, or
any other professional relationship between Battle Buddy Bears, its officers,
employees, contractors, or AI service providers and any user or child.
D. AI Interaction Data and Third-Party Providers
When a child interacts with Raffy, interaction data
including text, transcripts, and emotional check-in selections may be processed
by third-party AI providers under confidentiality and data protection
agreements. We take commercially reasonable steps to prevent children’s
personal information from being used to train third-party general AI models,
but we cannot guarantee third-party AI providers’ internal practices in all
circumstances.
3. HIPAA and Medical Privacy Disclaimer
Battle Buddy Bears LLC is not acting as a healthcare
provider, health plan, healthcare clearinghouse, or HIPAA-covered entity
through the Raffy App unless a separate written Business Associate Agreement or
covered entity agreement specifically states otherwise for a specific
institutional program.
Battle Buddy Bears LLC may have certain vendor agreements or
cloud service arrangements that support HIPAA-eligible infrastructure where
applicable. However, this does not mean that all Raffy App features,
third-party services, AI tools, speech tools, analytics, notifications,
communications, or user submissions are HIPAA-compliant.
The Raffy App is not intended to collect, receive, store,
process, or transmit protected health information (“PHI”) under HIPAA unless
Battle Buddy Bears has entered into required written agreements and implemented
required compliance procedures for a specific healthcare, hospital, or pilot
program.
Do not submit medical records, diagnosis information,
therapy notes, insurance information, Social Security numbers, or detailed
information about a child’s medical condition, trauma, abuse, or mental health
crisis through the Raffy App unless specifically directed through a secure and
HIPAA-compliant process.
4. Abuse Disclosure and Mandatory Reporting Notice
RAFFY IS NOT A MANDATED REPORTER. THE APP CANNOT REPORT
SUSPECTED CHILD ABUSE OR NEGLECT TO ANY AUTHORITY.
Children who have experienced abuse, neglect, or trauma may
disclose sensitive information during Raffy interactions. You acknowledge and
agree that:
- Battle Buddy Bears is a technology company, not
a social services agency, law enforcement agency, or mandatory reporting entity
under state or federal law;
- The Raffy App cannot detect, interpret, or
report child abuse, neglect, or endangerment;
- Interaction data processed by the App, including
AI-generated summaries, is not monitored in real time by Battle Buddy Bears
personnel;

through the App, caregivers are solely responsible for contacting the

5. Use of the App by Adults and Children
The Raffy App is intended to be downloaded, registered,
configured, and managed by adults, including parents, legal guardians,
caregivers, and other authorized users aged 18 or older.
Children may interact with Raffy only under the supervision
and with the express permission of a parent, legal guardian, or other
authorized adult. Children under the age of 13 should not create accounts,
submit personal information, register for the App, or independently manage App
settings.
- Parents and legal guardians are responsible for:
- Creating and managing the caregiver account

- Supervising the child’s use of Raffy at all
times

information
- Monitoring and reviewing AI interaction
summaries and caregiver alerts
- Contacting us with privacy questions or deletion
requests
6. Children Under the Age of 13 and COPPA Compliance
The Children’s Online Privacy Protection Act (“COPPA”)
requires us to inform parents and legal guardians about our practices for
collecting, using, and disclosing personal information from children under 13.
This section supplements and, in the event of conflict regarding children under
13, controls over all other sections of this Privacy Policy.
A. Verifiable Parental Consent
Before collecting personal information from a child under 13
through Raffy, we require verifiable parental consent. Our consent mechanism
may include one or more FTC-approved methods appropriate to the feature and
level of data collection. The specific method will be disclosed at the time
consent is requested.
B. No Collection Without Consent
We do not knowingly collect personal information from
children under 13 without verifiable parental consent where required. If we
discover we have collected such information without required consent, we will
promptly delete it or obtain appropriate consent.
C. Parental Rights Under COPPA
A parent or legal guardian may at any time: (1) review the
personal information collected from their child; (2) direct us to delete the
personal information; (3) refuse to allow further collection or use of their
child’s information; and (4) consent to collection while refusing to allow
disclosure to third parties. Requests may be submitted to
support@battlebuddybears.com.
7. Information We May Collect
The information we collect depends on how the Raffy App is
configured, which features are enabled, and how parents, caregivers, and
children use the App.
A. Information Provided by Parents, Guardians, or Caregivers
When an adult registers for or uses the Raffy App, we may
collect: name; email address; phone number; account credentials; relationship
to child; communication and notification preferences; customer support
messages; and feedback or survey responses.
B. Child Profile Information
To personalize Raffy’s experience, a parent or guardian may
provide: child’s first name or nickname; age or age range; birthday or birth
month/year; preferred language; general interests; comfort and emotional
learning preferences; and names of trusted caregivers (if voluntarily
provided). We ask caregivers to provide only what is necessary.
C. Child Interaction Information
When a child uses Raffy, the App may collect: emotional
check-ins and mood selections; coping tool and affirmation usage; guided
activity progress; story and video progress; App interaction history; written
transcripts or representations of interactions (if conversational features are
enabled); and parent-facing summaries or alerts based on App use.
D. Voice, Audio, and Biometric Data
If voice interaction features are enabled, Raffy may collect
temporary audio recordings or voice inputs. Voice data may be used to convert
speech to text, allow Raffy to respond, generate caregiver-facing summaries,
and improve functionality.
Important Notice Regarding Illinois BIPA and State Biometric
Laws: Voice prints or voice-derived biometric identifiers may be subject to the
Illinois Biometric Information Privacy Act (BIPA) or similar state laws. To the
extent voice data collected through Raffy constitutes biometric information
under applicable law, we will: (1) provide written disclosure prior to
collection; (2) obtain a written release where required; (3) retain biometric
data only as long as necessary for the stated purpose; and (4) permanently
destroy biometric data consistent with applicable legal requirements.
Caregivers may request deletion of all voice and biometric data by contacting
us.
Unless required for a specific enabled feature, audio
recordings are processed transiently and are not permanently stored. Written
transcripts may be retained for a limited period or until deleted by the
parent, subject to the retention limits described in this Privacy Policy.
E. Device, App, and Technical Information
We may automatically collect: device type; operating system;
app version; device identifiers; IP address; mobile network information; log
data; crash reports; diagnostic information; feature usage; date and time of
use; general location derived from IP address; and connectivity status needed
to operate, secure, troubleshoot, and improve the App.
F. Location Information
The App may request location-related information only for
specific functionality such as time zone, localized content, account security,
fraud prevention, or App performance. We do not use precise location to track
children for advertising purposes. You may control location permissions through
device settings.
G. Device Permissions, Microphone Access, and Parental Consent for Audio
The Raffy App may request access to certain device
permissions only when required for specific App functionality:
- Microphone:
Required to enable voice interaction features that allow a child to speak
to Raffy and receive spoken responses. Microphone access is only activated when
the voice interaction feature is in use and is not used to passively listen to,
monitor, or record background conversations.
- Notifications:
Required to send caregiver alerts, mood summaries, account notices, safety
notices, App updates, and legal notices to the caregiver’s device.
Parental Consent Required for Microphone Use by a Child:
Because Raffy’s voice interaction feature involves a child speaking to and
being heard by the App, a parent or legal guardian must provide explicit
affirmative consent before microphone access is enabled for a child under the
age of 13.
This consent is separate from the general account
registration consent and must be granted by the parent or guardian through the
App’s permission settings or during the initial setup flow. The parent or
guardian, not the child, must grant microphone permission on the device.
By enabling microphone access for your child, you represent
and warrant that: (1) you are the parent or legal guardian of the child; (2)
you have read and understood how voice data is collected, processed, and
deleted as described in Sections 7(D) and 17 of this Privacy Policy; and (3)
you consent on behalf of your child to the collection and processing of voice
input as described herein. You may revoke microphone consent at any time by
disabling microphone permissions in your device settings. Revoking microphone
access will disable voice interaction features but will not affect other App
functionality.
8. How We Use Information
We may use collected information to: create and manage
caregiver accounts; verify parental identity and consent; personalize the
child’s Raffy experience; process emotional check-ins and provide coping tools;
generate caregiver summaries and alerts; provide customer support; troubleshoot
and improve the App; detect and prevent fraud and security incidents; comply
with legal obligations; enforce our policies and legal rights; and protect the
safety and security of children, users, and Battle Buddy Bears.
We do not use children’s personal information for behavioral
advertising. We do not sell children’s personal information.
9. Caregiver Alerts and Emotional Check-In Notifications
The Raffy App may include caregiver-facing mood trends,
emotional check-ins, alerts, push notifications, and summaries. These features
are intended solely to provide general caregiver awareness. They are not
emergency alerts, medical alerts, therapy alerts, crisis alerts, abuse
detection tools, or substitute monitoring systems.
Battle Buddy Bears does not guarantee and expressly
disclaims any representation that the App will detect distress, prevent harm,
identify emergencies, or notify caregivers in every situation or in any
particular situation. Caregivers must not rely on Raffy as the sole or primary
method of monitoring a child’s safety, health, emotional state, or wellbeing.
10. How We Share Information
We do not sell personal information for money. We may share
information only as described in this Privacy Policy, including with: cloud
hosting and infrastructure providers; app development and maintenance
providers; speech-to-text and text-to-speech providers; AI language model
providers; database and storage providers; analytics providers; push
notification providers; security and fraud prevention providers; customer
support tools; email and communication providers; professional advisors; and
government authorities, courts, regulators, or law enforcement when required or
permitted by applicable law.
We may also share information to protect a child’s safety;
protect Battle Buddy Bears’ rights, property, or security; investigate fraud or
unauthorized access; comply with legal process; or enforce our agreements.
We may share aggregated, de-identified, or anonymized
information that does not reasonably identify a specific person or child. We
will not attempt to re-identify de-identified information.
11. Third-Party Service Providers
The App relies on third-party operators and service
providers for internal operations, including AI processing, speech processing,
storage, hosting, notifications, parental consent verification, customer
support, analytics, security, and App maintenance. We require service providers
to use information only as needed to provide contracted services and to comply
with applicable law. A list of key operators or service providers that collect
or maintain children’s personal information is available upon request.
12. No Sale of Children’s Personal Information
We do not sell children’s personal information. We do not
knowingly use children’s personal information for targeted behavioral
advertising. We do not knowingly allow third parties to collect children’s
personal information through Raffy for independent advertising purposes. If any
use of technology is considered a “sale” or “sharing” under applicable law,
eligible users may opt out by contacting us.
13. Parental Rights and Choices
Parents and legal guardians may: review personal information
collected from or about their child; request correction of inaccurate child
information; request deletion of child information; revoke consent for further
collection or use; refuse further collection; request information about our
data practices; and delete the child’s profile or caregiver account, subject to
legal and technical limitations.
To protect privacy and security, we may require identity
verification before responding to requests involving a child’s information.
Please contact: support@battlebuddybears.com
14. Adult User Privacy Rights
Depending on your location, you may have rights to: request
access to your personal information; request correction or deletion; opt out of
sale, sharing, or targeted advertising where applicable; and request
information about our data practices. Contact us to exercise these rights. We
may need to verify your identity before processing requests.
15. Additional State-Specific Privacy Rights
A. California Residents
California residents have rights under the California
Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”),
including the right to know, delete, correct, opt out of sale/sharing, and
limit use of sensitive personal information. California’s Age-Appropriate
Design Code Act (AB 2273) may apply to the Raffy App given its child-directed
nature. We are committed to compliance with applicable California child privacy
requirements.
B. Virginia, Colorado, Connecticut, Texas, and Other State Laws
Residents of states with applicable consumer privacy laws
may have additional rights similar to those described above. Contact us to
exercise any applicable state privacy rights.
C. Illinois Biometric Privacy
Illinois residents whose voice or biometric data may be
collected through voice interaction features have rights under the Illinois
Biometric Information Privacy Act (BIPA), including the right to receive
written disclosure, provide written consent, and request deletion of biometric
data. See Section 7(D) for additional detail.
16. Data Retention
We retain personal information only as long as reasonably
necessary for the purposes described in this Policy, unless a longer retention
period is required by law. Specific retention periods are as follows:
- Caregiver account information is retained while
the account remains active and for a reasonable period thereafter as required
by law.
- Child profile information is retained while the
child’s profile remains active within the caregiver account.
- Child Interaction Data — 7-Day Retention and
Automatic Deletion: All child interaction data — including AI conversation
transcripts, emotional check-in records, mood selections, coping tool usage
history, voice interaction transcripts, and caregiver-facing summaries
generated from child interactions — is retained for a maximum of seven (7) days
from the date of each interaction. At the end of the 7-day period, such
interaction data is permanently deleted and destroyed from Battle Buddy Bears’
systems and, to the extent commercially practicable, from the systems of
applicable third-party service providers. Battle Buddy Bears does not archive
or retain child interaction data beyond 7 days for any commercial, research, or
operational purpose unless separately required by applicable law or a specific
institutional agreement with a supplemental privacy notice.
- Early Deletion by Caregiver or Parent: A parent
or legal guardian may request deletion of their child’s interaction data at any
time — before the 7-day period expires — by using the in-App deletion controls
(if available) or by contacting Battle Buddy Bears at
support@battlebuddybears.com with the subject line “Child Interaction Data
Deletion Request.” We will process verified deletion requests within thirty
(30) days of receipt.
·
Voice audio, if collected, is processed
transiently and is not permanently stored unless a specific enabled feature
requires retention, in which case it is subject to the 7-day limit described
above.
- Technical logs are retained for security,
debugging, and operational purposes for a limited period consistent with
industry standards.
- Certain records, such as caregiver consent
records and legal correspondence, may be retained longer as required for legal,
tax, accounting, fraud prevention, or compliance purposes, but such records
will not contain child interaction content.
Parents may request deletion of all child information at any
time by contacting us at support@battlebuddybears.com with the subject line
“Child Interaction Data Deletion Request.”
