These Terms & Conditions and End User License Agreement (“Terms” or
“Agreement”) govern your access to and use of the Raffy mobile
application, caregiver dashboard, AI emotional support features, emotional
check-ins, child-friendly interactions, stories, videos, coping tools,
affirmations, notifications, digital content, and related services,
collectively referred to as the “Raffy App” or “App.”

The Raffy App is owned and operated by Battle Buddy Bears LLC
d/b/a Battle Buddy Bears (“Battle Buddy Bears,” “Company,” “we,” “our,”
or “us”).

These Terms apply to users who download, access, or use the Raffy App
through the Apple App Store, Google Play Store, or any other
authorized app distribution platform.

By downloading, installing, creating an account, accessing, or using the
Raffy App, you agree to be bound by these Terms and by the Raffy App Privacy
Policy.

If you do not agree to these Terms, do not download, install, create an
account, access, or use the Raffy App.

1. Important Safety Notice

RAFFY IS NOT AN EMERGENCY SERVICE. IF A CHILD IS IN IMMEDIATE DANGER,
CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

Raffy is an AI emotional support companion designed to provide comfort,
emotional learning, coping tools, affirmations, stories, guided activities,
caregiver awareness, and supportive child-friendly interaction.

Raffy is intended to support children and families navigating cancer,
trauma, grief, fear, sadness, anger, loneliness, stress, and other big
emotions.

However, Raffy does not provide:

• Medical care;
• Medical diagnosis;
• Medical treatment;
• Mental health therapy;
• Counseling;
• Psychiatric care;
• Crisis intervention;
• Emergency response;
• Suicide prevention services;
• Abuse detection;
• Abuse reporting;
• Child protective services;
• Continuous safety monitoring;
• Continuous health monitoring;
• Professional healthcare advice;
• Professional mental health
  advice;
• Any guarantee of emotional,
  behavioral, medical, therapeutic, developmental, or safety outcomes.

Raffy must not be used as a substitute for professional care, emergency
services, crisis services, adult supervision, caregiver judgment, or parental
responsibility.

2. Acceptance of These Terms

By using the Raffy App, you represent and agree that:

• You have read, understood, and
  accepted these Terms;
• You have read, understood, and
  accepted the Raffy App Privacy Policy;
• You are at least 18 years old;
• You are the parent, legal
  guardian, caregiver, or authorized adult responsible for any child using
  Raffy through your account;
• You have legal authority to
  permit the child to use Raffy;
• You will supervise the child’s
  use of Raffy;
• You will not rely on Raffy as
  medical care, mental health care, therapy, crisis support, emergency
  support, abuse reporting, or child safety monitoring.

If you do not meet these requirements, you may not use the Raffy App.

3. Adult Account Holder Responsibility

The Raffy App is intended to be downloaded, registered, configured, and
managed by adults, including parents, legal guardians, caregivers, or other
authorized users who are at least 18 years old.

Children may use Raffy only with the express permission and supervision
of a parent, legal guardian, caregiver, or authorized adult.

The adult account holder is solely responsible for:

• Creating and managing the
  caregiver account;
• Providing accurate account
  information;
• Providing required parental
  consent;
• Supervising the child’s use of
  the App;
• Reviewing App activity and AI
  interactions as appropriate;
• Managing child profile
  information;
• Managing device permissions;
• Determining whether Raffy is
  appropriate for the child;
• Seeking professional help when
  necessary;
• Contacting emergency services
  when appropriate;
• Ensuring that the child does not
  share unsafe, private, medical, or sensitive information through the App.

4. Children Under 13 and Parental
Consent

The Raffy App may be used by children under the age of 13 only with
verifiable parental or legal guardian consent where required by applicable law.

Children under 13 may not independently:

• Create accounts;
• Submit personal information;
• Manage App settings;
• Provide payment information;
• Communicate with Battle Buddy
  Bears directly;
• Consent to App permissions;
• Agree to these Terms on behalf of
  themselves.

Parents and legal guardians are responsible for providing consent,
supervising use, and managing any child-related information.

If you believe a child has used Raffy without proper parental consent,
please contact Battle Buddy Bears at:

5. Medical, Mental Health, Crisis, and
Emergency Disclaimer

Raffy does not provide medical advice, mental health advice, diagnosis,
treatment, therapy, counseling, crisis intervention, emergency assistance,
suicide prevention, abuse detection, or abuse reporting.

Nothing provided through Raffy, including AI-generated responses,
stories, affirmations, emotional check-ins, coping tools, caregiver alerts,
summaries, notifications, videos, or educational content, should be interpreted
as professional advice or professional care.

Raffy is not intended to diagnose, treat, cure, prevent, monitor, or
manage any disease, medical condition, psychological condition, emotional
condition, developmental condition, trauma response, crisis state, or safety
risk.

If you or a child are experiencing a medical emergency, mental health
crisis, suicidal thoughts, self-harm thoughts, abuse, neglect, violence,
danger, or any urgent safety concern, call 911 or contact the
appropriate emergency, medical, mental health, crisis, or child protection
services immediately.

Do not wait for Raffy to respond.

Do not rely on Raffy to detect, prevent, report, or respond to
emergencies.

6. HIPAA and Medical Privacy
Disclaimer

Battle Buddy Bears LLC is not acting as a healthcare provider, health
plan, healthcare clearinghouse, or HIPAA-covered entity through the general
consumer use of the Raffy App unless a separate written agreement specifically
states otherwise.

Battle Buddy Bears may use certain technology providers or cloud services
that offer HIPAA-eligible services or business associate agreements where
applicable. However, this does not mean that all Raffy App features,
third-party services, AI tools, speech tools, analytics tools, notifications,
communications, or user submissions are HIPAA-compliant.

Unless a separate written agreement specifically applies, Raffy is not
intended to collect, receive, store, process, or transmit protected health
information under HIPAA.

Users should not submit medical records, diagnosis information, therapy
notes, insurance information, Social Security numbers, emergency information,
detailed cancer treatment information, detailed trauma information, abuse
disclosures, or mental health crisis information through Raffy unless
specifically requested through a secure and appropriate process.

If health-related or sensitive information is voluntarily provided
through Raffy, it will be handled according to the Raffy App Privacy Policy and
applicable law, but it may not be protected under HIPAA unless a separate
HIPAA-compliant arrangement applies.

7. AI-Generated Content Disclaimer

Raffy uses artificial intelligence technology to generate child-friendly
emotional support responses, coping suggestions, affirmations, stories, and
related content.

AI-generated content may be:

• Inaccurate;
• Incomplete;
• Delayed;
• Misunderstood;
• Repetitive;
• Unexpected;
• Contextually inappropriate;
• Unsuitable for a particular
  child;
• Unable to recognize distress,
  danger, abuse, self-harm, suicidal thoughts, or crisis situations.

Battle Buddy Bears does not guarantee that Raffy will always understand a
child correctly, respond appropriately, identify distress, prevent harm, or
provide suitable support in every circumstance.

Raffy’s responses are not created, reviewed, or approved in real time by
licensed physicians, therapists, psychologists, counselors, social workers,
psychiatrists, or emergency professionals.

Parents, guardians, and caregivers are responsible for supervising Raffy
interactions and determining whether any response is appropriate for the child.

You agree not to rely on AI-generated content as professional advice,
medical care, therapy, counseling, crisis support, safety monitoring, emergency
assistance, or a substitute for adult supervision.

8. Abuse Disclosure and Mandatory
Reporting Disclaimer

Raffy is not a mandated reporter.

The Raffy App cannot detect, investigate, verify, interpret, or report
suspected child abuse, neglect, exploitation, violence, trafficking, unsafe
home conditions, or danger to any authority.

Battle Buddy Bears does not continuously monitor child interactions in
real time.

If a child discloses abuse, neglect, danger, self-harm, suicidal
thoughts, or any urgent safety issue through the App, the adult caregiver is
solely responsible for contacting the appropriate emergency services, law
enforcement, medical professionals, mental health professionals, crisis
services, or child protection authorities.

Do not rely on Raffy to report abuse or protect a child from harm.

9. Caregiver Alerts, Emotional
Check-Ins, and Notifications

The Raffy App may include emotional check-ins, mood selections,
caregiver-facing summaries, alerts, push notifications, and related tools.

These features are intended only to provide general caregiver awareness
and emotional learning support.

They are not:

• Emergency alerts;
• Medical alerts;
• Crisis alerts;
• Suicide prevention alerts;
• Abuse detection tools;
• Safety monitoring tools;
• Therapy tools;
• Diagnostic tools;
• Behavioral health monitoring
  systems;
• Substitutes for adult
  supervision.

Battle Buddy Bears does not guarantee that the App will detect distress,
identify emergencies, prevent harm, notify caregivers in every situation,
deliver notifications without delay, or accurately interpret a child’s
emotional state.

Parents and caregivers must not rely on Raffy as the sole or primary
method of monitoring a child’s safety, health, emotions, behavior, or
wellbeing.

10. No Guarantee of Results

Battle Buddy Bears does not guarantee any specific emotional, behavioral,
medical, psychological, therapeutic, developmental, educational, spiritual,
family, safety, or wellness outcome.

Use of Raffy does not guarantee that a child will:

• Feel better;
• Become calmer;
• Communicate emotions more
  clearly;
• Reduce anxiety;
• Overcome trauma;
• Improve behavior;
• Avoid crisis;
• Avoid self-harm;
• Avoid emotional distress;
• Experience any particular result.

Individual experiences may vary.

11. Scope of License

Subject to your compliance with these Terms, Battle Buddy Bears grants
you a limited, revocable, non-exclusive, non-transferable, non-sublicensable
license to download, install, access, and use the Raffy App for personal,
non-commercial use by you and children under your authorized supervision.

For users who download the Raffy App through the Apple App Store, this
license is limited to use on Apple-branded products that you own or control and
as permitted by the Apple Media Services Terms and Conditions, including Family
Sharing or volume purchasing where applicable.

For users who download the Raffy App through Google Play, this license is
limited to use on Android devices or other devices permitted by Google Play’s
applicable terms and policies.

You do not acquire ownership of the App, software, content, characters,
stories, code, technology, trademarks, or intellectual property.

All rights not expressly granted are reserved by Battle Buddy Bears.

12. Current No-Payment App Version

The current version of the Raffy App does not offer paid subscriptions,
premium plans, in-app purchases, recurring billing, or payment processing
through the App.

If paid features, subscriptions, premium plans, in-app purchases,
donations, or app-based payments are added in the future, Battle Buddy Bears
will update these Terms and provide any required payment, cancellation, refund,
auto-renewal, and app store disclosures before or at the time those features
become available.

13. Current No-Hardware / No-Bluetooth
App Version

The current version of the Raffy App does not include Bluetooth
connectivity, physical plush hardware integration, hardware pairing, or
connected device functionality.

Any references to Raffy as a companion, character, or emotional support
tool refer to the digital Raffy App experience unless otherwise stated.

If Bluetooth, hardware, plush companion integration, connected device
functionality, or physical device pairing is added in the future, Battle Buddy
Bears will update these Terms, the Raffy App Privacy Policy, and related
disclosures before or at the time those features become available.

14. User Accounts and Security

To use certain Raffy features, an adult may need to create an account.

You agree to provide accurate, current, and complete information and to
update it as needed.

You are responsible for:

• Maintaining the confidentiality
  of your login credentials;
• Restricting access to your device
  and account;
• Supervising any child who uses
  Raffy through your account;
• All activity that occurs under
  your account;
• Immediately notifying Battle
  Buddy Bears of suspected unauthorized access or security concerns.

Battle Buddy Bears is not responsible for loss, harm, unauthorized
access, misuse, or data exposure caused by your failure to safeguard your
account, device, password, or login credentials.

15. Child Profiles and Caregiver
Settings

Parents, legal guardians, or authorized caregivers may be able to create
child profiles, customize App settings, select emotional learning preferences,
review child activity, manage notifications, and control certain features.

You agree that any child profile information you provide is accurate to
the best of your knowledge and that you have the legal authority to provide it.

You agree not to provide unnecessary sensitive information about a child,
including medical records, diagnosis details, therapy records, abuse details,
emergency information, insurance information, Social Security numbers, or
highly sensitive family information, unless Battle Buddy Bears specifically
requests it through a secure and appropriate process.

16. Voice, Audio, and Interactive
Features

Raffy may include voice, audio, microphone, speech-to-text,
text-to-speech, or interactive conversation features.

By enabling or using voice features, you understand and agree that:

• Raffy may process voice or audio
  input to operate App features;
• Speech may be transcribed into
  text;
• AI or technology providers may be
  used to process interactions;
• Audio, transcripts, or
  interaction records may be handled according to the Raffy App Privacy
  Policy;
• Voice features may misunderstand
  a child or caregiver;
• Raffy may not always respond
  correctly or appropriately;
• Parents and caregivers are
  responsible for supervising voice interactions.

Microphone access is not used to passively listen to, monitor, or record
background conversations.

Do not allow a child to share private, sensitive, medical, emergency,
identifying, or unsafe information through voice features.

17. App Permissions

The Raffy App may request device permissions only when needed for App
functionality.

These permissions may include:

• Microphone access for voice
  interaction features;
• Notification access for caregiver
  alerts, App updates, account notices, and safety notices;
• Limited device or diagnostic
  access for App security, stability, and performance.

You may manage App permissions through your mobile device settings.

If you disable certain permissions, some Raffy App features may not work
correctly.

18. Acceptable Use

You agree not to use Raffy in any unlawful, harmful, abusive, unsafe,
exploitative, or unauthorized manner.

You may not:

• Use Raffy for medical
  emergencies, mental health crises, abuse reporting, emergency monitoring,
  suicide prevention, or safety monitoring;
• Use Raffy as a substitute for
  professional care or adult supervision;
• Submit false, misleading,
  harmful, unlawful, abusive, sexually explicit, violent, exploitative,
  discriminatory, or inappropriate content;
• Attempt to manipulate, jailbreak,
  override, bypass, disable, or interfere with Raffy’s safety systems;
• Attempt to make Raffy generate
  harmful, unsafe, sexual, violent, abusive, discriminatory, unlawful, or
  inappropriate content;
• Use Raffy to harass, exploit,
  groom, manipulate, threaten, or harm a child or any other person;
• Upload malware, viruses, harmful
  code, or security threats;
• Interfere with Raffy’s systems,
  servers, networks, operations, or security;
• Reverse engineer, copy, scrape,
  reproduce, resell, license, modify, or exploit Raffy or its content;
• Access or attempt to access
  another user’s account or data;
• Use Raffy in violation of any
  law, regulation, court order, app store policy, or third-party right;
• Submit protected health
  information unless specifically requested through a secure and appropriate
  process;
• Use Raffy for research, clinical,
  school, hospital, nonprofit, child advocacy center, or institutional
  purposes without written authorization from Battle Buddy Bears.

Battle Buddy Bears reserves the right to suspend, restrict, or terminate
access to Raffy if we believe these Terms have been violated or if continued
use may create risk, harm, legal exposure, reputational harm, operational
concerns, or security concerns.

19. Prohibited Child Safety Violations

Battle Buddy Bears has zero tolerance for any use of Raffy that harms,
exploits, endangers, abuses, manipulates, grooms, threatens, or sexualizes
children.

You may not use Raffy to:

• Solicit personal information from
  children without authorization;
• Engage in grooming, exploitation,
  or manipulation;
• Create, request, distribute, or
  discuss child sexual abuse material;
• Encourage self-harm, suicide,
  violence, or dangerous behavior;
• Encourage secrecy from parents,
  caregivers, guardians, or trusted adults;
• Facilitate abuse, neglect,
  trafficking, exploitation, or harm;
• Communicate with a child in an
  unsafe, deceptive, or unauthorized way.

Battle Buddy Bears may report suspected child exploitation, abuse,
imminent harm, or unlawful activity to appropriate authorities where required
or permitted by law.

20. User Content, Feedback, and
Submissions

You may submit information, feedback, support messages, comments,
reviews, suggestions, testimonials, or other content to Battle Buddy Bears.

By submitting content, you represent that you have the right to submit it
and that it does not violate any law, privacy right, intellectual property
right, confidentiality obligation, or third-party right.

You grant Battle Buddy Bears a non-exclusive, worldwide, royalty-free
license to use, reproduce, modify, display, distribute, and create derivative
works from feedback, suggestions, reviews, testimonials, or non-sensitive
submissions for business, support, improvement, operational, or promotional
purposes, unless prohibited by law or agreed otherwise in writing.

Do not submit sensitive information, medical records, child trauma
details, abuse details, private child information, confidential information, or
information you do not want used or stored.

21. Intellectual Property

Raffy and all related content are owned by or licensed to Battle Buddy
Bears LLC unless otherwise stated.

This includes, but is not limited to:

• The Raffy App;
• Software;
• Code;
• Designs;
• User interface;
• Logos;
• Trademarks;
• Product names;
• Characters;
• Raffy;
• Ruby;
• Stories;
• Videos;
• Audio;
• Illustrations;
• Emotional learning content;
• Affirmations;
• Coping tools;
• Guided activities;
• Text;
• Graphics;
• Brand elements;
• Documentation;
• Training materials;
• Business concepts;
• Digital resources.

You may not copy, reproduce, modify, distribute, display, publish, sell,
resell, license, reverse engineer, scrape, exploit, or create derivative works
from Raffy or Battle Buddy Bears content without prior written permission.

These Terms do not transfer ownership of any intellectual property to
you.

22. Trademarks

“Battle Buddy Bears,” “Raffy,” “Ruby,” related logos, product names,
slogans, characters, designs, and brand elements are trademarks, service marks,
trade names, or proprietary assets of Battle Buddy Bears LLC or its affiliated
entities.

You may not use our names, logos, characters, trademarks, or branding
without prior written permission.

23. Privacy

Your use of Raffy is governed by the Raffy App Privacy Policy.

Please review the Raffy App Privacy Policy carefully to understand how
Battle Buddy Bears collects, uses, stores, discloses, and protects information,
including information related to children.

If you do not agree with the Raffy App Privacy Policy, do not use Raffy.

24. Third-Party Services and App
Stores

Raffy may be downloaded through the Apple App Store, Google Play Store,
or other authorized app distribution platforms.

Your use of those platforms may be subject to their own terms, privacy
policies, family policies, device policies, and account rules.

Raffy may also rely on third-party providers for cloud hosting, AI
processing, speech-to-text, text-to-speech, notifications, analytics,
authentication, customer support, security, and other operational services.

Battle Buddy Bears is not responsible for third-party platforms,
third-party services, outages, errors, data practices, content, or independent
policies, except as required by applicable law.

25. Apple App Store Additional Terms

If you downloaded Raffy from the Apple App Store, the following
additional terms apply:

1. These Terms are between you and
   Battle Buddy Bears LLC, not Apple Inc. Apple is not responsible for the
   Raffy App or its content.
2. Apple has no obligation to
   provide maintenance or support services for Raffy.
3. If Raffy fails to conform to any
   applicable warranty that cannot be disclaimed, you may notify Apple, and
   Apple may refund the purchase price, if any, for the App. To the maximum
   extent permitted by law, Apple has no other warranty obligation with
   respect to Raffy.
4. Apple is not responsible for
   addressing any claims by you or any third party relating to Raffy or your
   possession or use of Raffy, including product liability claims, legal
   compliance claims, consumer protection claims, or intellectual property
   claims.
5. If a third party claims that
   Raffy infringes that party’s intellectual property rights, Battle Buddy
   Bears, not Apple, will be solely responsible for investigation, defense,
   settlement, and discharge of such claim, to the extent required by these
   Terms and applicable law.
6. You represent and warrant that
   you are not located in a country subject to a U.S. government embargo or
   designated by the U.S. government as a “terrorist supporting” country, and
   that you are not listed on any U.S. government list of prohibited or
   restricted parties.
7. You must comply with applicable
   third-party terms when using Raffy.
8. Apple and Apple’s subsidiaries
   are third-party beneficiaries of these Terms and may enforce these Terms
   against you as a third-party beneficiary.

26. Google Play Additional Terms

If you downloaded Raffy from Google Play, the following additional terms
apply:

1. These Terms are between you and
   Battle Buddy Bears LLC, not Google LLC. Google is not responsible for
   Raffy or its content.
2. Your use of Raffy may also be
   governed by Google Play’s applicable terms, policies, and family
   requirements.
3. Google has no obligation to
   provide maintenance, support, refunds, or warranty services for Raffy,
   except as required by Google Play policies or applicable law.
4. Battle Buddy Bears is responsible
   for Raffy’s content, support, and legal compliance, except for matters
   controlled by Google Play or your Google account.
5. You agree to comply with
   applicable Google Play terms and policies when downloading, accessing, or
   using Raffy.

27. Updates, Changes, and Availability

Battle Buddy Bears may update, modify, suspend, discontinue, replace,
limit, or remove Raffy features at any time, with or without notice.

We do not guarantee that Raffy will always be available, uninterrupted,
error-free, secure, compatible with every device, or free from delays or
technical issues.

Raffy may be unavailable due to maintenance, updates, outages, internet
issues, third-party service disruptions, app store issues, cloud provider
issues, device problems, cyberattacks, or events beyond our control.

28. Beta, Pilot, and Testing Features

Some Raffy features may be offered as beta, pilot, test, early access,
limited release, or experimental features.

Beta or pilot features may be incomplete, unstable, inaccurate, limited,
or discontinued at any time.

You agree not to rely on beta, pilot, or testing features for medical,
mental health, crisis, emergency, safety, clinical, or essential purposes.

29. Hospital, School, Nonprofit, Child
Advocacy Center, and Pilot Program Use

Raffy may be used in future hospital, school, nonprofit, child advocacy
center, research, grant-funded, or pilot program settings.

Such uses may require additional written agreements, parental consent
forms, privacy notices, data-sharing agreements, security requirements,
institutional approvals, school permissions, hospital approvals,
healthcare-related agreements, or supplemental terms.

These Terms do not create a healthcare provider-patient relationship,
therapist-client relationship, school-student relationship, hospital-patient
relationship, fiduciary relationship, or emergency service obligation.

Unless separately agreed in writing, Battle Buddy Bears is not
responsible for how hospitals, schools, nonprofits, child advocacy centers,
caregivers, researchers, or other third parties use, supervise, distribute,
monitor, or administer Raffy.

Raffy may not be used in institutional, clinical, hospital, school,
research, nonprofit, or child advocacy center settings without written
authorization from Battle Buddy Bears.

30. Export Control and Legal
Compliance

You may not use, export, re-export, import, or transfer Raffy except as
authorized by United States law and the laws of the jurisdiction in which Raffy
was obtained.

You represent and warrant that you are not prohibited from using Raffy
under applicable laws, sanctions, embargoes, or restricted party lists.

You agree to comply with all applicable laws, regulations, and app store
rules when using Raffy.

31. Disclaimer of Warranties

RAFFY IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, BATTLE BUDDY BEARS DISCLAIMS ALL
WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY,
RELIABILITY, AVAILABILITY, UNINTERRUPTED OPERATION, AND SUITABILITY FOR ANY
CHILD, FAMILY, MEDICAL CONDITION, EMOTIONAL CONDITION, TRAUMA HISTORY,
DEVELOPMENTAL NEED, OR MENTAL HEALTH NEED.

BATTLE BUDDY BEARS DOES NOT WARRANT THAT:

• Raffy will always operate without
  interruption;
• Raffy will be error-free;
• Raffy will always provide
  accurate, appropriate, safe, or helpful responses;
• Raffy will detect distress, harm,
  abuse, emergencies, suicidal thoughts, self-harm thoughts, or crisis
  situations;
• Raffy will prevent harm;
• Raffy will meet your
  expectations;
• Raffy will be suitable for every
  child;
• Raffy will produce any specific
  emotional, behavioral, medical, therapeutic, educational, developmental,
  or safety result;
• Raffy will be free from technical
  problems, delays, bugs, security issues, or third-party service failures.

Some jurisdictions do not allow certain warranty disclaimers, so some of
these limitations may not apply to you.

32. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BATTLE BUDDY BEARS LLC, ITS
OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, DEVELOPERS,
VENDORS, AFFILIATES, PARTNERS, LICENSORS, ADVISORS, SERVICE PROVIDERS, AND
REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, EMOTIONAL, MEDICAL, PSYCHOLOGICAL,
SAFETY-RELATED, PERSONAL INJURY, DATA LOSS, OR OTHER DAMAGES ARISING OUT OF OR
RELATED TO:

• Use of Raffy;
• Inability to use Raffy;
• AI-generated responses;
• Child interactions with Raffy;
• Caregiver reliance on Raffy;
• Emotional check-ins;
• Caregiver alerts or missed
  alerts;
• Delayed notifications;
• Misunderstood voice or text
  input;
• Incorrect, incomplete,
  inappropriate, unsafe, or unexpected responses;
• Technical errors;
• Service interruptions;
• Data loss;
• Unauthorized access;
• Third-party services;
• App store issues;
• Use of Raffy in a medical,
  school, nonprofit, hospital, child advocacy center, research, or pilot
  setting;
• Any reliance on Raffy as medical
  care, mental health care, therapy, crisis support, emergency support,
  abuse reporting, safety monitoring, or professional advice.

TO THE FULLEST EXTENT PERMITTED BY LAW, BATTLE BUDDY BEARS’ TOTAL
LIABILITY FOR ANY CLAIM RELATED TO RAFFY SHALL NOT EXCEED THE GREATER OF: (A)
THE AMOUNT YOU PAID DIRECTLY TO BATTLE BUDDY BEARS FOR THE RAFFY APP OR RELATED
SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B)
ONE HUNDRED DOLLARS ($100.00).

Because the current version of Raffy does not include paid subscriptions,
in-app purchases, or paid app access, this limitation may result in the maximum
liability being one hundred dollars ($100.00), unless applicable law requires
otherwise.

Some jurisdictions do not allow certain limitations of liability, so some
of these limitations may not apply to you.

33. Assumption of Risk and Informed
Consent

By creating a caregiver account or permitting a child to use Raffy, you
acknowledge and agree that:

• You understand Raffy is an
  AI-based emotional support tool, not a human caregiver or professional
  provider;
• You understand AI-generated
  responses may be inaccurate, inappropriate, incomplete, delayed, or
  inadequate;
• You understand Raffy cannot
  reliably detect emergencies, crises, abuse disclosures, suicidal thoughts,
  self-harm thoughts, or danger;
• You understand that children may
  misunderstand, over-rely on, or emotionally attach to AI-generated
  responses;
• You voluntarily choose to allow
  the child to interact with Raffy with knowledge of these limitations;
• You assume responsibility for
  supervising the child’s use of Raffy;
• You assume responsibility for
  deciding whether Raffy is appropriate for the child;
• You assume responsibility for
  seeking professional medical, mental health, crisis, emergency, or child
  protection assistance when needed.

Nothing in these Terms limits rights that cannot be waived under
applicable law.

34. Release of Claims Related to
Supervised Child Use

To the fullest extent permitted by law, you acknowledge and agree that
you are responsible for supervising any child’s use of Raffy and for deciding
whether Raffy is appropriate for that child.

You release Battle Buddy Bears from claims arising from:

• Your failure to supervise a
  child’s use of Raffy;
• Your reliance on Raffy as a
  substitute for professional care or adult supervision;
• Your decision to allow a child to
  use Raffy;
• Your failure to seek professional
  or emergency help when needed;
• Your failure to review Raffy’s
  responses or App activity;
• Your failure to manage account
  settings, permissions, or caregiver notifications.

Nothing in these Terms waives rights that cannot be waived under
applicable law.

35. Indemnification

You agree to indemnify, defend, and hold harmless Battle Buddy Bears LLC,
its owners, members, officers, directors, employees, contractors, developers,
vendors, affiliates, partners, licensors, advisors, service providers, and
representatives from and against any claims, damages, losses, liabilities,
costs, and expenses, including reasonable attorneys’ fees, arising out of or
related to:

• Your use or misuse of Raffy;
• A child’s use of Raffy under your
  account or supervision;
• Your violation of these Terms;
• Your violation of the Raffy App
  Privacy Policy;
• Your violation of any law,
  regulation, app store policy, or third-party right;
• Your submission of false,
  misleading, unlawful, sensitive, or unauthorized information;
• Your failure to supervise a
  child’s use of Raffy;
• Your reliance on Raffy for
  medical, mental health, crisis, emergency, abuse reporting, safety
  monitoring, or professional care;
• Your use of Raffy in a hospital,
  school, nonprofit, research, child advocacy center, or pilot setting
  without written authorization;
• Your infringement or misuse of
  Battle Buddy Bears intellectual property;
• Your failure to obtain required
  consent from a parent, guardian, caregiver, institution, or authorized
  party.

36. Suspension and Termination

Battle Buddy Bears may suspend, restrict, or terminate your access to
Raffy at any time if we believe:

• You violated these Terms;
• You violated the Raffy App
  Privacy Policy;
• You created risk or potential
  harm;
• You misused Raffy;
• Your account was compromised;
• Your use creates legal, safety,
  operational, reputational, or security concerns;
• Continued access is no longer
  appropriate or available.

You may stop using Raffy at any time.

You may request account deletion according to the Raffy App Privacy
Policy.

Sections of these Terms that by their nature should survive termination
will survive, including intellectual property, disclaimers, assumption of risk,
limitation of liability, release, indemnification, governing law, and dispute
terms.

37. Force Majeure

Battle Buddy Bears is not responsible for any delay, failure, outage,
interruption, data loss, or inability to perform caused by events beyond our
reasonable control, including natural disasters, severe weather, war,
terrorism, labor disputes, supply chain disruptions, internet failures,
cyberattacks, power outages, app store issues, cloud provider outages,
third-party service failures, government actions, pandemics, or other events
beyond our control.

38. Governing Law

These Terms are governed by and interpreted in accordance with the laws
of the State of West Virginia, without regard to conflict of law principles,
except where federal law or applicable consumer protection law requires
otherwise.

39. Dispute Resolution

Before filing any legal claim, you agree to first contact Battle Buddy
Bears at:

The parties agree to attempt in good faith to resolve the dispute
informally.

Nothing in this section prevents either party from seeking emergency
injunctive relief, reporting safety concerns, contacting regulators, contacting
law enforcement, contacting child protection authorities, or taking action
where required by law.

40. Arbitration and Class Action
Waiver

To the maximum extent permitted by applicable law, any dispute, claim, or
controversy arising out of or relating to these Terms or your use of Raffy
shall be resolved by binding individual arbitration, rather than in court,
except for claims that may be brought in small claims court or claims that
cannot be subject to arbitration under applicable law.

The arbitration shall be conducted by the American Arbitration
Association under its applicable Consumer Arbitration Rules, unless another
arbitration provider or process is required by applicable law.

The arbitration may take place in West Virginia, remotely, or by written
submissions, as permitted by the arbitration rules and applicable law.

To the maximum extent permitted by law, you and Battle Buddy Bears agree
that disputes must be brought only in an individual capacity and not as a
plaintiff, class member, or representative in any class action, class
arbitration, collective action, private attorney general action, or
representative proceeding.

Nothing in this section limits parental rights under COPPA or other
applicable child privacy laws.

Some jurisdictions do not allow mandatory arbitration or class action
waivers in certain circumstances, so some of these provisions may not apply to
you.

41. Changes to These Terms

Battle Buddy Bears may update these Terms from time to time.

If we make material changes, we may notify users by updating the
effective date, posting a notice in the App, sending an email, requiring
re-acceptance, or using another reasonable method.

Your continued use of Raffy after updated Terms are posted means you
accept the updated Terms.

If you do not agree to the updated Terms, you must stop using Raffy.

42. Severability

If any provision of these Terms is found to be unlawful, invalid, or
unenforceable, the remaining provisions will remain in full force and effect.

43. No Waiver

Battle Buddy Bears’ failure to enforce any provision of these Terms does
not constitute a waiver of that provision or any other provision.

44. Assignment

You may not assign or transfer these Terms or your rights under these
Terms without prior written permission from Battle Buddy Bears.

Battle Buddy Bears may assign or transfer these Terms in connection with
a merger, acquisition, sale of assets, reorganization, financing, change of
control, or by operation of law.

45. Entire Agreement

These Terms, together with the Raffy App Privacy Policy and any
additional terms, notices, or consents provided in connection with specific
features, constitute the entire agreement between you and Battle Buddy Bears
regarding your use of Raffy.

47. App Store and Google Play
Submission Notice

These Terms are intended to apply to the Raffy App and related digital
features.

Battle Buddy Bears and its development team should review these Terms
before Apple App Store or Google Play submission to confirm that the Terms
accurately match Raffy’s actual features, data practices, AI functionality,
third-party providers, child-facing features, caregiver tools, safety
limitations, and platform disclosures.

If Raffy’s features change, these Terms should be updated before or at
the time those changes are released.
